Sheffield United To Launch New Legal Action


Following their failure to secure promotion to the Premiership via the backdoor of the play offs, Sheffield United are investigating the possibility of new legal actions to compensate for their extended stay in the Championship. The £20m already agreed with West Ham was designed to compensate for the initial demotion and a further season's stay outside of the Premiership; however, with today's failure to secure a return to the land of milk and honey, the Sheffield United board are now pursuing new legal avenues.

A source close to the club said: "West Ham are ultimately responsible for today's defeat. We were stripped of a number of our key players following relegation who would undoubtedly have secured victory for us today. The settlement agreed out of court may be regarded as binding as far as West Ham are concerned but we believe otherwise."

But West Ham are not the only club sweating on a legal ruling. The source continued: "We are seeking to overturn the decision to promote Burnley. It seems self evident that the team promoted should be the one that ends up with the most points over a season. We finished above Burnley and the playoffs are an illogical contrivance. We will be using the precedent of the Premiership to prove our case. Chelsea are not in a play off with Villa for a place in the Champions League are they? Chelsea have qualified based on their league position. What holds for the Premiership should apply to the teams seeking promotion to the Premiership. We are confident of proving this point in a court of law."

The scorer of the winning goal, Wade Elliot, is also in the frame. The source continued: "We are investigating a third party agreement in relation to Mr Elliot. If our information is correct, it appears that Mr Elliot is either married or committed to a member of the female sex. We have a sworn affidavit which states that, in the event of his partner giving birth on the day of a game, Mr Elliot would be deselected from the team. This is clearly a Third Party Agreement in breach of FA rules."

Referee Mike Dean also faces a compensation claim. Controversy centres on the decision to send off Jamie Ward for a "deliberate hand ball" and the failure to award two penalties to Sheffield United. The spokesman said: "Ward was seeking a hypothetical advantage when handling the ball. To exact punishment for a hypothetical is absurd. The failure to award the penalties is clearly a dereliction of duty on the part of Dean. He is a cheating bastard, end of. We will make him pay!"

The final plank in the legal action centres on Burnley's club colours. The spokesman finished by saying: "It has not escaped our attention that Burnley wear claret and blue. Our lawyers have investigated the precedent of the Tollpuddle Martyrs and it is self evident that there is an illegal secret association here. Tevez may not have played for Burnley today but he was there in spirit. We are confident that, not only will we be compensated and promoted to the Premiership, but West Ham will be transported to Australia. Their captain, Lucas Neill, will help them settle somewhere in the Outback."

Yet another stupid pathetic post made in the name of football. The majority of WHU and SU fans want to put this behind them but some people just like to keep dragging it out, probably because they have nothing sensible to write.

This isn't remotely funny and it has nothing at all to do with football. It is written by a so called hammers fan who rarely attends games and who professes to have good knowledge of the game.

For all Sheff Utd fans out there, I apologise profusely for this idiotic prose. You can do without it today.

I watched the game today and to be fair Burnley were probably the better team but the second penalty claim was probably justified. Hard luck and I really do hope you have better luck next year.

they got relegated simply because they weren't good enough to stay in the premiership

they didn't get promoted today simply because they didn't play well enough to beat Burnley

they are a horrible side who aren't good enough for the premiership and who complain about something that isn't even true that happened a few seasons ago

I am happy to state that West Ham were guilty, that the PL and FA let us down and that SU used the rules to sue us. Do I agree with the compensation? No but it is better than having points deducted isn't it?

As soon as SU get promoted it should put an end to all this rubbish once and for all. Now we have at least another year of it.

I accept also that Warnock screwed up but WEST HAM BROKE THE RULES. What part of that statement do you not understand?

I attend all home games and about 12 away games a year. That is an awful lot more than you. I appear to be an oddball as I do not hold many grudges and I don't "hate" opposition teams like Sheff Utd, Tottenham and Man Utd.

I genuinely like football and the great name of West Ham was dragged through the mud by a stupid cover up over the Argentinians. As we all know, had they not joined us, we probably would not have struggled that season and SU may well have gone down anyway.

WH have themselves to blame for the mess and it is short sighted for anyone to blame others. Get over it.

as i have already mentioned sheffield united were not good enough to stay in the premiership

it was not because of tevez that sheffield united went down

i do remember that sheffield united beat west ham in a game when tevez was playing!

and all sheffield united had to do on the last game of the season to stay up was to get a home draw against wigan

they failed to do that and suffered the consequences

sheffield united only have themselves to blame

and also about this whole tevez thing, how come west ham are always getting done in for it but manchester united are not?

Spot on 1915! The Mancs don't own him and never have owned him! And the Mancs only won the Premiership that year because of a third party Agreement with Everton not to play Howard in the fixture against them. A kid conceded 3 and the Mancs overturned a two goal deficit to pick up three points!

Anonymous 1915 - WH broke the rules because of the 3rd party agreement as the owners could exert influence and WH covered it up. Of course SU weren't good enough but WH could and should have had points deducted.....

Hammersfan again - Man Utd agreed the terms of the Tevez deal beforehand, unlike WH. We messed up big time and it was not all Brown, Magnusson didn't help.

Trevor, love to meet for a drink. Genuinely. Chatting West Ham with any West Ham fan over a couple of beers is almost always good value.

With regard to us "messing up", there wasn't a person in the country who thought the deal was legitimate when we signed Tevez and Mascherano. Why didn't the Premier League and FA satisfy themselves before they gave clearance for us to pick them? The questions were obvious and the legal documentation fairly straightforward. How do we know there isn't an unsigned, unspoken agreement between the Mancs and IKEA?

Sheff Utd are historically a second division club and so they will be playing another season in their true level again next year.

Annonymous 1928 - Comparing the Tevez and Kappa situations is really not fair although I take your point.

I think that you will find that Tevez was not legally contracted to WH, for no other reason than they lied in the first place. The arbitration hearing determined that.

Believe me, I want it out the way now. My point is that we were very lucky in the first place not to be deducted points. Whether you like it or not we were guilty as hell

Excellent article, very good. Personally, I was delighted that Sheff Utd lost and PARTICULARLY glad that it was by the one goal AND that they had a penalty shout turned down by a ref who they weren't happy with before. Brilliant! Their 'the world is against us' complex has just got significantly worse! I'd laugh if it was revealed years later that Mike Dean was a West Ham fan as a kid! They'll all end up sat in the corner, gently rocking, mumbling to themselves "it's all West Ham's fault, they've got agents everywhere, think of a happy place". P.S. The people who come on here moaning beggar belief. The more comments, the higher this blog goes up. And for the anon who 'has written to NewsNow'....get a life and (novel idea) CLICK ON SOMETHING ELSE YOU INBRED HALFWIT! The internet has at least four or five other sites you could go on, there may even be six or seven and they deal with a variety of subjects, you should try it! Maybe writing letters to teacher on other sites works (maybe you've got form on that score, eh anon?) for you, personally I think its pretty pathetic.

here's an idea hammersfan, if you're so committed to what you write, why not make yourself known outside the ground for the first game of the season to let the fans show their appreciation in person of the wonderful work you do on this site and personally congratulate you on your spot on posts. do you know where the ground is? i for one would personally give you a big pat on the back for your work. might be a bit too ballsy for you to actually show your face though to be honest so i guess you'd never show up for a game, pity.

Oh dear Gregor, that could open a large can of worms. The Org is a West Ham forum. I and a handful of others were banned from the site, I maintain for having views contrary to an Orthodoxy, they contend because I am a secret Spurs fan determined to undermine anything and anything West Ham through my seditious views. Most of the bile comes from a faction on the site determined to close down this blog because of the perceived threat it poses. All very childish in my opinion but I am as guilty as they are. I still post on the org and enjoy the exchanges because my most vehement critics on here don't know it is me and engage in half decent conversations with their arch enemy. The site used to be very good; in my opinion it has lost its spark which is why I now call it the Mordant Org.

Excellent piece Fanno. I was thinking of writing something similar but my wit isn't as sharp as yours.

TrevorH I think you are one of the few sensible fans prepared to see all sides of an argument rather than just the partisan view. I like to think I am the same but this legal business with Sheffield United is where we disagree. Sure our club's management cheated and lied about Tevez but he was registered properly as I understand the matter. The FA decision, based on evidence from Kia's lawyer that he had been given what was described as "verbal cuddles" by Scott Duxbury. To my mind that is a gentleman's agreement which is no different to the Kabba case that Sheffield United have lied about since but never had to answer. And finally who is to say that we should have been given a points deduction? There was no precedent of a 3rd party influence case so why assume that we should have had a points deduction? That original independent committee decision was never judged as being wrong or lenient.

And just for the record, it was our 'old' management team that were quilty not the new owners! + Tevez was cleared to play for the last 3 games, so if Sheffield have any beef then maybe its the FA they should be whinning at, why do you think the FA could not punish us anymore!? because they had already sanctioned Tevez to play, stop crying Sheffield, maybe one day u will get out of the fizzy league.... actually i doubt it!!

However I fear that your open minded attitude towards giving 'them' a chance to vent there ignorance, has put paid to contributors (of very good articles) such as CelticHammer who I think got fed up of being slagged off. I found him on another site recently. Shame.

Oh for goodness sake.
West Ham DID break rules, but it was a technicality rather than an actual advantage. The offending contract gave Kia the rights to sell Tevez and Mascherano at any time which would have DISADVANTAGED West Ham. That's kind of the opposite of cheating. It was stupid and it was against the rules but as someone already said, there was no precedent that meant it should be a points deduction.

People also forget that at the time of the original hearing, we were all but relegated anyway and a points deduction would have been criticised for being no penalty at all. Hence, the greedy swines at Soho Square thought that they would hit us for a quick cash injection to the senile old gits christmas party fund. It's not our fault that Scumfield United threw away a ten point lead and relegated themselves.

The Blunts were the worst team in the league over the season and as a result deserved to be relegated. They also played the worst football at Wembley on Monday and both Burnley and the Blunts deserve to be in the division they will be playing in next season.

As for this article...nice work.

It's sad that people just don't get it.
